How can I track the progress of my cases?

Last updated April 9, 2024

All actions and stages of the amicable recovery process for a case can be tracked and monitored from the customer interface.

In addition to these real-time shared updates, a performance report is provided at the end of the amicable phase, detailing the status of the collections.

How can I track the progress of my cases?

>Collected : In this case, the Respaid collection agents, the lawyer's office in charge of the case or the creditor itself is in possession of proof of payment. The reminders stop automatically, and the information that the debtor has settled his debt is sent to the creditor.

Lawyer procedures are stopped. The debt is settled. Collection fees agreed when implementing the debt table are due. Details of the destination of the funds are given.

>Promise to pay : The debtor announces his intention to settle the debt at a later date. We will therefore propose a date by which the debtor can settle the debt in full. Notifications are suspended and resume if the debtor has not paid after the date of the promise to pay.

>In progress : Reminders continue automatically. The debtor can contact the lawyer by email, post or telephone for further information on the debt and to answer any questions, take out a credit card payment or even ask for a payment schedule to be set up.

>Payment installment : The implementation of a payment installment plan is an option that is valid only if the first installment is paid within 48 hours through the dedicated payment link. Failure to activate the installment plan will restart the contentious proceedings.

The payment of the first installment by the debtor allows the suspension of collection actions against them until the debt is fully settled.

In such cases, the debtor makes monthly payments via credit card or bank transfer to the Lawyer's office until the debt is fully settled.

Each month, the lawyer's office remits the funds to the creditor, deducting the collection fees, through a "Retrocession Slip."

>Disputed : In this case, Respaid collection agents, the lawyer's office in charge of the case, or the creditor directly, are in possession of a written, reasoned objection from the debtor. The reminders stop automatically.

Examples of disputed payments are : The debtor's identity is incorrect, the debtor does not recognize or disputes the debt, the debtor's discharge, a discrepancy between the amount to be recovered and the amount owed by the debtor, a request for supporting documents made to the creditor which has gone unanswered, insolvency.

In the event of a dispute raised by the debtor and a notification to the user-customer, a response is requested from the user-customer . If there is no response from the user-customer within 4 working days, the case is cancelled and the case fees are payable to the lawyer's office.

>Insolvent : In this case, Respaid collection agents, the lawyer's office in charge of the case or the creditor directly have proof of overindebtedness. Reminders stop automatically.

>Cancelled : Cases can be canceled for various reasons, such as the debt not being eligible for collection at the time, the debt being already handled by another third-party collection agency appointed by the creditor, a written request from the creditor to stop the collection of a case, a written proof from the debtor regarding the non-eligibility of the debt, termination, or unresolved dispute not taken into account. Follow-ups automatically cease.

In case of cancellation of the amicable collection case for reasons directly related to the Creditor User, Respaid reserves the right to charge the Creditor User a fixed fee of 31.68 USD excluding taxes per case for expenses and time incurred.

>Completed : The collection process did not result in the recovery of the debts. The lawyer may continue their actions through home visits or phone calls to the debtor.

Notes can be added for each line of debts provided by the lawyer handling the case or Respaid collection agent.

In addition to all this information, a statistical report is provided, including the amounts recovered, amounts currently under collection, and the distribution in both amount and percentage for all labels.
